Cursing at you. Insulting you. Calling you names. Threatening you. Sending you insulting text messages or pictures. These are all examples of workplace bullying. If the bullying is being done because you have a disability or because of your race or gender for example and the bullying begins to interfere with your work then it becomes illegal.

Workplace violence in California is a constant problem for employees.

Workplace violence is more prevalent than most people expect. Some workplace violence can lead to serious consequences for the employee and employer. Violence includes, but is not limited to, batteries, assaults, physical aggression, threats of physical violence and unwanted physical touching. All workplace violence should be reported to your local police department.

When workplace violence is reported by an employee the company is required to investigate, criticize, censure, terminate, suspend or otherwise take action against the aggressor to ensure the safety of the employee/victim. If the employer knows about the workplace violence but does nothing about it the employer will be viewed as a joint participant in the assaultive employee’s acts and can, among other actions, be sued for assault and battery along with the employee.
