Individuals who work for hospitals, clinics, nursing homes or other medical facilities providing health care to patients have special protections under the California Health and Safety Code.
The State of California encourages employees, patients, nurses, members of the medical staff, and other health care workers to notify government entities of suspected unsafe patient care and conditions. No health facility shall discriminate or retaliate, in any manner, against an employee or medial staff member of the health facility because that person has reported on an unsafe condition for patients or filed a grievance.
In California when a health care worker is fired within 120 of making a complaint or grievance to the medical facility or to a government agency there will be a presumption of discrimination and retaliation.
If you are a health care worker and believe you have been retaliated against after reporting any type of unsafe condition in the medical facility you should call our office immediately. We act quickly and aggressively to represent health care workers all that they are entitled to under the law.
James Nobles created the Law Offices of James E. Nobles after working as an in-house-counsel for a major vitamin/health supplements company and a record label. A major part of his job was to defend the companies when they were sued for harassment, discrimination and other employment law violations. Using defense attorney secrets, James has switched sides, and now uses that knowledge to win cases for employees
