Individuals who work for hospitals, clinics, nursing homes or other medical facilities providing health care to patients have special protections under the California Health and Safety Code.

The State of California encourages employees, patients, nurses, members of the medical staff, and other health care workers to notify government entities of suspected unsafe patient care and conditions. No health facility shall discriminate or retaliate, in any manner, against an employee or medial staff member of the health facility because that person has reported on an unsafe condition for patients or filed a grievance.

In California when a health care worker is fired within 120 of making a complaint or grievance to the medical facility or to a government agency there will be a presumption of discrimination and retaliation.
